Calls for Loya Jirga Contravenes the Law: ARG

KABUL - The Presidential Palace has also called on government officials to refrain from taking part in processes that are in contravention of the constitution.
The Presidential Palace (ARG) on Thursday ruled out any truth in rumors of the holding of a Loya Jirga, stating that talking about Jirgas or convening unofficial Jirgas was in violation of Afghanistan’s constitution.
In addition, ARG has called on government employees to avoid taking part in processes which are not in accordance with the constitution.
This comes after former president Hamid Karzai said that holding a traditional Loya Jirga was the only option to consolidating and strengthening national consensus and to get the country out of its current crisis.
“Those individuals who are rallying for a Jirga from their own standpoints, their statements have no compatibility with the prevailing laws of the country,” said President Ashraf Ghani’s spokesman Shahhussain Murtazawi.
Legal experts meanwhile said that moves to hold a Loya Jirga outside government's authority was in violation of the constitution.
“In the presence of the Loya Jirga which has been included in the constitution of Afghanistan, holding traditional and consultative Loya Jirgas which do not have executive approval are against the law,” said legal expert Wahid Farzahyee.
“Today Mr. Karzai calls for a Loya Jirga, their objective is in fact a big Jirga, and it is not the Jirga which has been laid out in the constitution,” said Sayed Eshaq Gailani, head of Nahzat-e-Hambastagi Milli Afghanistan party.

“It is not correct that the Americans stay in their bases and war continues in the country, we do not need this process and this decision,” said Karzai last November.  (Tolonews)
